Bicyclists say Irvine is responsible for bike trail accident

that's retarded. no wonder we're not allowed to ride anywhere.

I wouldn't let you damn sue-happy mountain bikers on my property either with that kinda of weak excuse for self accountablity.

So I live in Irvine and it looks like pretty soon I will not be able to ride anywhere. I guess it is one of the safest cities in the country.
 
I'm not familiar with that particular bike path but from what I read it sounds like they the injured cyclists may have a point...

If that vehicle was really parked in the middle of a path right after a blind corner at the bottom of hill it seems like a pretty clear cut case of negligence on the part of the workers. I mean the least they could have done was put out cones to warn folks they were there. It also sounds like there may have been dirt/gravel from the construction from the construction making it more difficult to stop on those skinny road tires.

Anyway, the real facts will likely come out in litigation.

Hopefully the city is not at fault, but if they are, it seems only fair that these folks aren't bankrupted in addition to being brain damaged by the carelessness of a few city workers.
 
If it was the truck speeding around a blind corner and hitting a bike, the truck would automatically be at fault.
 
I hope these two get nothing. But that won't be the case.

Part of why I bought my own acreage to ride on with no BS and no restrictions.
 
This is a tough one...especially not knowing all the details. First, I hope that all parties involved live long and healthy and good things come from all this...and by good things i mean the lawyer who filed the lawsuit doesnt get a dime. With that said, I cant help but rant a little about the situation...this reminds of someone who sues because they trip over a crack in the sidewalk...saying the city is at fault cause they were unable to negotiate the 1/2" lip and they twisted their ankle...or they sue cause although there is a bike lane...it wasn’t quite big enough or marked well enough so when they ride a little too fast and crash...its not their fault...its the city for now warning them of possible hazards. Bottom line is whether if your riding on the road or dirt or walking down the street you need to have your head on a swivel and looking for bad things that can happen...you cant expect to go thru life and blindly cruise along as if nothing will ever happen...I cant ever think of a time when I am riding and not thinking WHAT IF...especially around blind corners, darken tunnels, etc...and if said bad things do happen…take responsibility for your actions…wtf is wrong with people. cheers
 
This is right by my house so I'm pretty familiar with the area the article talks about.

As far as the downhill goes - the extent of the downhill is about 15-20ft in elevation change. Basically, you're dropping down from Jeffrey to cross the road through a tunnel.

If you go to the middle of this map, you'll see where the sidewalk/bike path heads north, does a 180 hairpin and turns underneath the street.

Honestly, you shouldn't be going too fast there, as any good bike path warrior should know. You shouldn't be going that fast around a corner into a tunnel. Or maybe they weren't going that fast..and just suck at riding? :?:
 
50/50. Sounds like someone wasnt wearing their helmet, or possibly not wearing it properly and possibly going too fast and the truck shouldnt have been parked on the bike path. Truck should have been parked on the street above and the workers should have walked their asses to the work area.

I believe it would also be the drivers fault even if he wasn't speeding. It is unassured clear distance and that is the ticket I got when I slammed into the back of a car parked in my lane as I came out of a blind corner. The owner of the car was also given a parking ticket but was not at fault for the accident. In this case it seems to me that it should have been up to the cyclist to make sure the path was safe for the speed they were traveling.

As the President of STUPIDASS, I thought surely you'd have something to add to those poor injured cyclists' claim. Can you say bike path sanitation?

YOU....... If your on a bike, you are the smaller craft. NEVER ASUME SOMEONE ELSE WILL SEE YOU...NEVER ASUME THE PATH IS CLEAR.....

I've ridden that trail many times on the road bike.
It is a blind corner, going into a fairly dark tunnel.
Every time that I've travelled it a good amount of caution was used.
Slow, look, ride. Mostly because I didn't want to give a pedestrian a 700mm enema.
If they were traveling at a rate of speed higher than a fast walk, it is most likely the cyclists fault.
Cali is "the sue me state" because of bottom feeder lawyers whom make everyone thing they hit the lotto when something bad happens.
