    i heard this morning on the stephanie miller (who recently came out) show that he had recently come out to his parents. regardless, it's a tragic loss--and i'm sure the students that taped him will be doing time. idiots...

    From what I've read (and thus obviously not knowing all of the facts), I think your analysis is spot on. Assuming the suspects don't have a history of criminal behavior, I tend to believe that this incident was simply the result of immaturity and acting without thinking about the possible consequences. Even so, I do disagree with you that their punishment should be limited to civil liability and expulsion. What they did was a crime (a felony) and they should be prosecuted for it. Should they do a long prison sentence? Probably not. This situation is truly tragic and I feel for all parties. It's shame that these suspects, if they are otherwise good kids, acted so thoughtlessly and have probably screwed up the rest of their lives.

    if they did it because he was gay, then--to me--it's a hate crime. we'll have to see what comes out in court.

    Just because he recently came out doesn't mean that his being gay was a non-issue. We know that he recently revealed his sexual preference to his parents but we sure as hell don't know how they reacted to it. My family's reaction to my coming out was a mixed bag. My brothers and sisters were awesome but my relationship with my mother greatly suffered and has never fully rebounded. Chances are the fallout from coming out combined with the video pushed him to his limit. We all have a limit and everyone's is different.

    I honestly don't agree with the whole "hate crime" thing.

    I have been targeted because of my race, and my presumed orientation, more than a few times.

    Why does one reason matter more than another?

    A crime is a crime.

    I believe that they began using "hate crimes" as a separate crime because those crimes specifically target a certain group and have a higher level of rage, are more vicious, and tend to have greater physical as well as mental scars. Not to mention that the intent is to suppress the entire group that is targeted--an emotional "lesson" to the group that they need to live in fear or this will happen to them. It is a crime upon the whole community, not just the one victim.

    I understand the theory supposedly behind it.

    I just don't agree with the application of it as I have experienced it - both as a witness and as a victim.

    Making a distinction between committing a crime because "I hate people that act in a certain manner" vs " I hate people that act in a certain manner because they are of a particular group as well" is just not right.

    As I have posted, I have been the victim of what would be legally considered a hate crime on more than one occasion. I could care less why they did it. I only care that justice is served at the maximum level.

    I mean, what makes a murder or assault any less of a crime because it didn't meet the criteria of a hate crime? IMHO, that's total bullsh!t.

    It's too bad that the kid couldn't have said, "yeah, so what? What about it? I got some, obviously you didn't, because you were too busy video taping me..." What drove him to kill himself was not that he was gay or that his gay sex was broadcast on the internet. What drove him to kill himself was the response he anticipated from the greater community (friends, family, co-workers, students, etc). It was the "unknown" that drove him to those ends.

    Imagine a world where people would say, "Yeah, everybody's got different bits and pieces. We all have an x,y or z and who really cares what you do with it. At a certain point, we all become familiar with the human anatomy. Who cares?" But the fact is, sex is still used to scare, blackmail, intimidate... and sell products. How many executives or people of higher power are out there right now, being controlled by others based on the threat of being outed? Maybe it's for something gay, an affair, those trips to Thailand for the lady-boys, that kink caught on tape... whatever it is, sex is still very much used to control and manipulate (wanna keep your job? your wife? your kids? Then you will vote for this bill...etc.etc.)

    The world would be a much better place, if everyone just said, "yeah, I like (fill in the blank), so what?"

    People who live in glass houses shouldn't throw stones... And the majority of the time, it's those throwing the stones, that have the most to hide...

    When I hear about things like, I lose a little hope in humanity. I just don't understand why there wasn't someone there to tell him, "Look man, not the end of the world. Karma's a bit**." From my experience, college isn't really all that diverse. I'm tired of hearing that word, "diverse." Everybody and their mothers claim that they're diverse, especially Universities.

    I agree with Fewinhibitions, a crime is a crime. I think they want to throw the 'hate' crime in there for sentencing, to add on some years. It's just a damn friggin' shame that somebody didn't tell the kid that it wasn't the end of the world, he was clearly talented.
