    Glad you came away with only minor injuries. I have a couple names in my head that weren't so lucky.

    Does not give you the burden of proof needed to prosecute the act as an assault. If the perpetrator did not intend
    to run into the cyclist it is not an assault. A car accident is not an assault just because the driver fled the scene.
    You need to go beyond the Penal Code subsection and find the definition of assault then it will not be so "vague"
    to you.

    If not an ADW.. then maybe just another average, everyday "car vs. bike hate crime." Those are getting pretty common around here.

    I have an update on this. The CHP officer who took my report staked out the area this morning and spotted a gold Infiniti with a missing right mirror passing the scene at about the same time. When he pulled it over, the driver denied being involved in a collision with a cyclist. However, when questioned as to why his mirror was missing, he claimed to have been involved in an alleged collision with a truck the previous day in the same area. Surprisingly, he said he was unable to locate the "truck" or his mirror immediately after the alleged collision despite allegedly driving up and down the road a couple times and thus did not file a police report. The officer will be forwarding details on the case to the DA. I'll let you draw your own conclusions as to the what it's going to say. Needless to say, I am a big fan of the CHP!

    Wow! Congrats on the good news. Lets hope the D.A. has enough to prosecute this Jackal.
    Did they impound his car to match the mirror you found to it?
    Kudos to such a dedicated CHP officer!

    There has to be a way to match that mirror to that car. I hope this guy doesn't get away with this.

    Sorry to hear about the incident. I'm really stoked to hear about the CHP's involvement. Sounds like they were following up on the original investigation-all on their own. Great to hear this sort of news!!!

    No, seriously--that is great to hear that they followed through and sounds like they got the jerk. Saw a Corolla with no side mirror on it on the toll road this morning but I would've had to go 90 to get his plate...

    ThinkFast has the right idea here.. The driver most likely drives the route on a regular basis.. maybe was going to work.. I'd take a couple days and park over by the stables with a cup of coffee and some donuts for a stakeout.. Glad your ok.. I drive that road a few days a week and will keep an eye out. Let us know if any new info develops..

    Wow, are his statements not an admission of guilt? You know darn well he didn't drive up and down looking for that mirror because you were there. Plus, it would've been hard to hit a truck on that road on that side. He would've been much better off saying that he had no idea how or where it happened. I'm very impressed with the CHP. Keep us posted.

    Good point. Plus, you have some witnesses who didn't see him going up and down either. NAILED. So glad you are ok, this is some icing on the cake...

    Take pictures, get checked out by a doc., and talk with an attorney. In the event you find the car you may be able to et repair costs for your bike, etc..
