who cares if its legal or not legal for him to shoot/threaten people to stay off his property?

the point is that if the guy that owns the land is serious enough to put up a threat to keep people off of it, then we should do just that.

if this were in texas no one would even question it, but apparently people feel the need to converse about how its not ok for someone to want people off his land...

If it is outdoors (not inside his home), unarmed, and you are not facing the shooter directly he will be spending time behind bars and signing checks with lots of zeros at the end if he shoots at anyone.

Would there be enough zeros to buy the land and turn it into a mountain bike park?

This is the road from the firestation side, not the dirt roard across from O'neil Park right?

I usually go in/up across the street from the monestary and come back down/out across the street from the firestation. You can see the pool across the canyon from the top of O'neil park.

I think there is an some sort of easement law stating something like, if you can proove that the road has been used for so many years to access an area of land, without permission of the owner, then the public has a right to use it and it is deemed public land or something. However, if the owner gives permission for the land to be used for some purposes, then the owner has a right to take back that land for public use. Or something like that. Aren't there any lawyers on here?

As for shooting at someone who isn't threatening you, I believe that is a matter for criminal AND civil court. He has a shaky stance either way.

California is pretty loose in protecting property owners rights. Try trespassing in many states in the West and they take things seriously.

The term "prescriptive easement" is generally used where an individual, or a small group of individuals, claim some right to an easement on another's property. Where private property is being used by the public without the permission of the owner, an argument can be made for an "implied dedication" granting the public access to that property.

There are several elements that have to be proven for a prescriptive easement or implied dedication. One of the burdens of proof is to establish that the public use was significant enough to warrant an implied dedication. Courts can vary as to what constitutes a significant use by the public but it often requires some kind of permanent improvement or substantial use other than simply riding mountain bikes on it. Another problem is that if the access is being sought on hehalf of the public, the standing to bring suit would likley lie only with the city/county unless state law has provided for a private attorney general statute (a statute that allows a private citizen to bring suit to enforce a public right). I am not aware of any such statute.
 
The part about it being posted "no trespassing" isn't a new thing. It's been post for almost 20 years now. It use to be skate destination and not a very good one at that.
 
I say to each their own, but just think about it... Even if the crazy guy does shoot you and goes to jail or gets his pants sued off... You could be seriously hurt (blinded, deafened, paralyzed) or even killed... I guess its not worth F'ing with a crazy guy who doesn't want you on his land.

When I was a kid I was with my foster brothers and we were stealing watermelons from a farmer next to our ranch ( we did this on a regular basis). He knew it had been happening for a while and was waiting for us. He got me that night with rock salt and it tore right through a brand new pair of Levi's and penetrated the skin. Let me tell you, it stung for days even after sitting in a bathtub of water for hours. I hid the pants so I wouldn't get into trouble. A year or so later I got kicked out of there for some other stuff. One of my foster brothers ended up getting shot with the rock salt. The farmer, who was really just protecting his property was arrested and spent over a year in jail and almost went to prison. I was pulled into court to testify that I'd been shot before. So I believe if this guy shoots somebody even with rock salt, he better have a good attorney.

He was obviously a damn good shot, Mike, cause you are a pretty small target. ;)

Exactly, I dont care who you are or what you have you threaten me and its on, I grew up in Socal, and in the 80s and 90s , bring it, the avg weight of the boys I ride with are 250lbs. One as big as nearly 290lbs , you had better be a bad ass mofo, even then your done.:bang:

here in Gravy Holler if someone goes past our house on the gravel road to 4 wheel or hunt or wat ever they plan on doing back there we come out with a gun and tell em to turn around. sometimes even shooting the gun in the air. I dont think its illegal in this state(KY) atleast because the lady i rent from has been doing it for years and almost everyone knows your gonna get greeted witha 12 guage if you go back there. She even tells people I'll shoot at you just as much as i'll look at you.
