Woman charged in hit-and-run death of bicyclist

    March 19, 2010|By ANDREW GALVIN

A Riverside woman has been charged in the December hit-and-run death of a bicyclist in Newport Beach, prosecutors said Friday.

Patricia Ann Izquieta, 37, of Riverside, was under the influence of prescription drugs when the Saturn SUV she was driving struck Donald Murphy from behind while he was bicycling with two friends on Jamboree Road on Dec. 9, the Orange County District Attorney's Office said in a news release.

After hitting Murphy, who was riding along the curb, Izquieta fled the scene, dragging Murphy's bicycle under her car for more than a mile before stopping in a Coco's Bakery parking lot, prosecutors said.

Izquieta was taking medications including Methadone and Clonazepam, and police determined the drugs impaired her for purposes of driving, prosecutors said.
Murphy 49, of Irvine, died a day after the crash due to severe head and neck injuries.

Izquieta is charged with one felony count of hit and run with death or permanent injury, one felony count of vehicular manslaughter while intoxicated without gross negligence, and one misdemeanor count of driving without a valid license with a sentencing enhancement for causing great bodily injury.

Murphy's family issued a statement in December forgiving Izquieta, saying she did nothing intentionally wrong.

Ok, found the link to today's article: http://www.ocregister.com/news/murphy-286676-izquieta-hit.html

SANTA ANA – A Riverside woman has been convicted in the hit-and-run death of a bicyclist in Newport Beach while under the influence of prescription drugs.

Patricia Ann Izquieta, 38, pleaded guilty Tuesday to one felony count of hit and run with death or permanent injury, one felony count of vehicular manslaughter while intoxicated without gross negligence, and one misdemeanor count of driving without a valid license with a sentencing enhancement for causing great bodily injury, prosecutors said.

COURTESY OF ORANGE COUNTY DISTRICT ATTORNEY'S OFFICE.

She is expected to be sentenced to three years in state prison on March 11.

Izquieta was under the influence of prescription drugs when the Saturn SUV she was driving struck Donald Murphy from behind while he was bicycling with two friends on Jamboree Road on Dec. 9, 2009, the Orange County District Attorney's Office said in a news release.

After hitting Murphy, who was riding along the curb, Izquieta fled the scene, dragging Murphy's bicycle under her car for more than a mile before stopping in a parking lot, prosecutors said.

Izquieta was taking medications including methadone and clonazepam, which impaired her driving, they said.

Murphy, 49, of Irvine, died a day after the crash due to severe head and neck injuries. Following the incident, Murphy's family issued a statement forgiving Izquieta, saying she did nothing intentionally wrong.

"It is important for everyone to also understand that, just like Don would have done, the young lady charged with this terrible accident has been forgiven by the family," the 2009 statement said. "The family believes that there was no malice on her part and would like for all of you to also pray for her, so that we could find peace within her and God for what happened."

Murphy, a husband and father of two, was a civil engineer and had firm Christian faith that made him a "pretty motivated guy to help others," his brother, John Murphy, told the Register in an interview. Much of his spare time was spent at halfway houses where he helped people find sobriety.

If you ever need to kill someone, and they happen to be a cyclist, just run them over.

If she wasn't higher than a kite, she'd probably be looking at no prison time. We live in a car culture-a driver's licence is more important than a jerkoff on a bike.

Dragging the poor guy for a mile is not malicious?

I'm glad the family can find forgiveness in their heart but that statement doesn't make much sense to me.

I think it was the bike that was drug for a mile. Still the punishment doesn't seem to fit the crime at all. Wonder if there is some sort of underlying back story that is causing the judge and the da to be lenient with her as far as her punishment... or is our system so backwards that crimes like this only get a slap on the wrist. None the less, it sounds like a ridiculous sentence.

Seems like every time some motorist kills a cyclist little to nothing is the outcome. The courts just don't feel the need to make people responsible for their actions when it comes to cyclists. Want to have somebody whacked? Put them on a bike and have the assassin run over them. If they do get caught they'll get less time because they were sober. Looks like the penalty for littering is worse then running over a cyclist.

Jesus. methadone is basically heroin... the other stuff is anti-seizure medication. If she had run into a car and killed someone what would the sentence have been? How ironic that the victim helped people get sober and he got run down by someone whacked out of her mind... no justice...
