Default RR: DMV ride

This may become long winded as I am lived.So bear with me.For those who did not see my earlier post,it was "I am so mad"; in what thread I don't know because I was not thinking.The jist is my car was towed for expired tags by two days ( waiting for tags in the mail)by the street sweeper police.So I live like 2 blocks from the Fullerton DMV and I figured it would easier to ride my bike there than call. It was not to busy , so I got through fast, imagine that on a day like today. Normally for street sweeping you just get a ticket. So I inquired with the DMV and find out (once again) Child Support suspended my license and with held my registration.I had no idea because I received no info of this. However 3 months ago or so they ( child support) suspended my license by mistake.Well it happened again, some paper work error.I got a notice from child support a long time ago that my license will be suspended for one missed payment in OCt 2007 ( I did not know they could do this, but the fight is futile).So I payed the missed I payment and confirmed it. I guess they did not enter it in the computer.Anyhow the DMV will not release my car until Child Support gives them a release. For bureaucratic, money stealing reasons the last time I needed a Release from child support it took well over a month.Now don't get me wrong,If you think there is some other story, "NO" I always pay my child support, but they screwed up and now I am paying for it! Now you figure an impound fee of 35 $ a day for a month ( guessing)plus all the other fees, im looking at probably well over 2 grand. My car is not worth that much.So I am just gonna sign the title over to the tow yard.Now for those of you that have not dealt with child support, they can screw your life,more so than the IRS I think. When me and my ex separated I lost my house ect........But thats another subject.Me and my ex are friends, but I am a little jaded.Case in point, in the courts right now ;a guy went to a sperm bank 18 years ago, child support is now going after him for 18 years of back support, no joke!!! I know a few people on here have had child support issues, so they can feel my pain. Thanks all you DEAD BEAT PILES OF CRAP that make us dads who love and cherish our kids pay for you WORTHLESS LIFE .I don't even know what I am saying ,or why im putting this on a public forum. I just dont no what to do and man!!!!!!!!! I don't know. I guess the positive is they can never take mountain biking from me, maybe thats my point! I will be riding a lot now until I can buy a new car and sort out this mess.Anybody have a Cheap road bike?

Dude you have guts for airing out his stuff . I hope everything works out for you man. This is my biggest fear of getting married and having kids. Its a womens world now. The child support and alamony is so crazy on what they want you to pay.

If you sign your car over to the tow yard you may try go back and bidding on the car you may get it cheaper than the original tow fees.

I feel for you. My GF's ex had his license revoked once since he did not pay. It got so bad that he is getting his checks garnished. Before he was working a construction gig that didn't report his earnings in the books. Yes, that is true, the person would also owe back pay until the child turns 18 but this rule is different state to state. In your defense, you can also take this to court and get the numbers readjusted based on your pay scale.

Man it sucks, but like you said, you still have your Mtn bike and I'm guess you still have your heath. So go put it to some good use and take out some frustration on a trail (you'll climb and ride faster)

If you do not pay I can understand taking your license, but I have support taken from my checks so I do not have to think about it.Child support just screwed me.As far as the guy for back support issues, He was A SPERM donor, no attachment to the mother who used his sperm!!! So how can they go after him for support 18 years later???

So I went and ground out the loop on the big bike. Funny thing is I forgot about it all. As John keepwhathappens said, i forgot everything and focused on my ride. Did not crash until now, reality sets back in.Big kids on bikes, a step back to childhood!!!

BH8,

I'm a divorce lawyer so I know the frustration you are going through. I must say, however, that this one takes the cake.

The sperm donor case that I know of was someone who did not go through a sperm bank but rather helped out a "friend". Sperm donors who go through sperm banks are protected from child support claims. Plus, in California, most people cannot seek retroactive child support. A person filing for child support can only get support from the filing date forward. I think that welfare reimbursement cases are limited to one year retroactivity (but I'm not sure about that). All of this, of course, doesn't really address your problem.

Sorry to hi-jack the thread but I have to ask. Is it plainly published anywhere what the rules on retroactive child support are?

Someone close to me got a girl pregnant (they were both married to other people at the time). She had the kid and put her husband as the father on the birth certificate.

Sometime later the husband found out the kid wasn't his and divorced her. Sometime later she came after my 'friend' and the courts ordered him to pay child support and also retroactive pay since the time of birth.

When she was pregnant, she told him that she would never seek support from him since they were both cheating and didn't want to harm the marriage.


He's now having about 80% of his monthly wages garnished for child support - ouch.

See California Family Code section 4009. Actually, for the initial application for support, it can be retroactive to the date that the Petition was filed so long as the obligor was served with the Petition within 90 days. Otherwise it can only be retroactive to the date that the obligor was served with the Petition. Such retroactivity is within the judge's discretion. I have never seen a judge make an original order retroactive to the service date of the Petition when the initial request for support was made some time after the filing date of the Petition. Modification orders can only be retroactive to the date that the obligor is served with notice of the application for modification.

I'm sorry for your recent troubles. I do empathize, I really do. I'm recently divorced and have 3 kids. The way I resolved the child-support issue (or non-issue) is I wanted my kids and so did my ex. So we met half way and we both get them 50% of the time. No child-support, no courts and no b.s.

If you make a shiat load more money then your ex does, then I think she could still collect child support; not to mention alimony. I guess it all comes down to how much you two can or did agree on and how much you let the courts decide. I've never been to court for divorce matters and don't intend to. Nothing two grown adults who have a mutual interest (understatement) can't resolve, IMO. I understand it's far more complex then just that so I'm not passing judgement but rather, just sharing my scenario with you. Yes, it cost me a pretty penny in attorney fees and I gave more then I took but in my mind, I wasn't looking to nickel and dime my ex. More she struggles, the more my kids will struggle. I didn't want that so I gave her the benefit of the doubt and took the high road.

Well, Just a little update. I signed the tiltle over on my car and the cost to me was 35 dollars. I will just buy a new car soon. I guess in a way its a good thing, I have to ride more. Plus I am moving a block away from my kids in two weeks, so I dont really need a car.I did call child support and they said they made a mistake. However that does not cover my cost.I have my kids, my health and great support here on STR. So just a day in life.Oh well, it always works out, I just need to stay positive.Thank you all for listening!Oh and I may need to Carpool for rides that are far!

Great to see that you can still find some positives in all this. In the end, I think that is key.

One look at your kids and all the pain and frustrations are worth any hassle.

My Kids are more important to me than anything money can buy. In the end I just want them to respect me as a good father! I cant buy them the latest greatest gadgets, but I can be their father!

Keep your head up dude. It'll work out. Being a father is the greatest gift one can have, so it's worth all this hassle. You are lucky you get along with your ex. Many of my friends tell me they'd rather go through a murder trial than go through a divorce again. LOL.
