wow things are getting pretty harsh in here, I was only responding to what it would take to drop some smelly stuff...
I'd LOOOOVE to be called for jury duty, I think it would be fascinating (in both the sense of discerning what is involved in the courtroom process and in terms of people watching) but I may be a bit biased since as a city employee you get full pay for it... still would be interesting though. |

I agree that serving jury duty is a civic responsibility. The true purpose of the jury is to not only judge whether or not the defendant is innocent or guilty under the law, but also to judge whether or not the law itself is just. It is yet another check and balance to government power built into the constitution.
This concept is sometimes referred to as jury nullification http://en.wikipedia.org/wiki/Jury_nullification However, modern courts have come to despise the concept of the people actually judging the correctness of the law. In 2001 the CA supreme court essentially ruled the concept of jury nulification illegal http://homepage.smc.edu/sindell_steven/AJ3%20Folder/Currentevents/aj3.jury.nullific.html So if you want an easy way out of jury duty, during panel selection one of the attorneys or judge will ask something along the lines "can you follow jury instructions and render a verdict of guilt or innocence based on the law". If you answer that question "NO, I believe it is every citizen's right to judge the correctness of the law in addition to the guilt or innocence of the defendant" you will be dismissed so fast your head will spin. If you want to be a total ass, bring it up as a question to the judge doing the jury orientation in the morning. That way you've "poisoned" the whole jury pool for the day. If you want to serve on a jury and actually employ jury nullification, if appropriate, (say you believe mary-jane ought to be legal) you need to keep the fact that you are judging the law to yourself. During deliberations, keep voting innocent and insisting that you do not see enough evidence to convict. If it comes out that you are judging the law, the other jurors can have the judge remove you from the panel and replaced with an alternate. There is a cute saying that sums up the basic tennants of liberty: Quote:

They told a bunch of us to come back @ 11:00am. Came back, sat around for 30 mins...lunch break - come back at 1:25pm. From here on out groups of 100s were getting called for the questionaire. This was how they randomly selected people... long process but fortunately for me I must have answered something right on the questionaire that they didnt select me Interesting thing about this is I have an LA County address on my DL cause I used to live w/my sister. So the Jury Notice goes to her address and I've always gone to court advising them that I dont live in the county. This year I received one for Compton, same deal I appeared in the jury room, told them I dont live in LA county and I got out of it. Ironically when I got home there was a notice from Riverside Cnty for yesterday... All good, as I'm done for this year... |

I usually don't mind jury duty. Last case I was on, we sometimes got to show up after 8, had extended lunches and got released by 3. Luckily Westminster court is only a few blocks away from my house and Santa Ana Superior isn't too bad.
Glad I don't live in LA County anymore. Going to downtown LA for court sucked. I work for the Feds too, but doesn't automatically excuse me. |
