Default Avian nesting/breeding season starts Feb 1

Friendly reminder that the avian breeding/nesting season is approaching. It usually starts on February 1st and runs till August 31st.

As required by Federal law under the Migratory Bird Treaty Act (MBTA) and California law under the Fish and Game Code, the construction of a wireless antenna (including antenna structure, equipment and utility routes) must consider the potential impacts on almost all avian nesting species, except house sparrow, European starling and feral pigeons.

In order to comply with these regulations during construction, the construction manager and crew should be able to identify any and all nests in and close to the areas of proposed construction. Important to remember that almost all structures can support avian nesting habitat and are subject to a nesting survey. Structures to be surveyed include, but not limited to the following: ornamental trees/bushes/shrubs, existing antenna towers/poles, buildings, utility poles, lattice towers and any other structures that may be disturbed during construction.

**my editorial**
A bit of sarcasm here but with regulations like these I’m surprised they let us ride/hike/etc on some of these trails. Got this email today regarding avian breeding/nesting season. So if you’re out there cutting new trails (legal or otherwise) please pay close attention to your surroundings.

Back east we had an Osprey nesting on a monopole. It caused alot of handover failures and we couldn't do anything about it until it decided to leave after a few months.

you're also a telecommie? damn. we're taking over!

(ex telecommie here- NEPA/Phase I side)

one worse that i've seen here: a perigrin falcon (species of concern) nest on a SCE lattice tower that Nextel was trying to build on.

even better:

Cingular/Bechtel wanting to build a site in prime coastal sage scrub community AND during the calfornia gnat cacher breeding season. doh! To date, the site still isnt built (in laguna canyon)

do the NEPA docs still have the blurb in them about radio frequencies not harming humans?

this doesnt work for telecom- the FCC is eventually involved and so we have to dot every i and cross every t.

i heard from an OLD biologist that one of the ways they used to do bird ID/counts was with a shotgun.
